During his time with the U.S. Attorney office, there has been plenty of controversy over the prosecution of many black politicians. Members of the black community in D.C. have complained that the office targeted black politicians during the investigations that led to the convictions of three council members and the chief of staff. Cohen countered their complaints with this statement, “We prosecute conduct. We don’t prosecute color.”

When controversy over the investigation into former D.C. Mayor Vincent Gray grew, Cohen left the office. Soon after, his successor announced that the investigation into Gray was done.
