DLA Piper Acquires Permanent Injunction for MAKO Surgical Corp.

The law firm of DLA Piper announced via a press release that it has secured the entry of a court ordered permanent injunction against Blue Belt Technologies, Inc. and Jeffrey Gellman on behalf of MAKO Surgical Corp.

The firm filed a comprehensive motion for preliminary injunction, which led to the decision. DLA Piper also completed the discovery process quickly. This included the depositions of corporate representatives.

Blue Belt and Gellman were sued by MAKO in U.S. District Court of the Southern District of Florida. The lawsuit claims that Blue Belt hired Gellman as a West Area Vice President of Sales even though Gellman had a non-compete contract with MAKO. Gellman also had confidentiality agreements in place with MAKO.

“Obtaining the substantial permanent injunctive relief against Blue Belt and Mr. Gellman in such an expedited manner was a tremendous result for the client” said Michael Austin, partner at DLA Piper, who led the team representing MAKO.

The decision was made on April 4 and it enjoins Gellman from working in any position for Blue Belt until August of 2013. When that time comes, Gellman is only permitted to work in a limited position and capacity until 2014. Gellman and Blue Belt have also been ordered to stop using and remove proprietary information from MAKO they currently have in their possession.
