Enclosed is a letter I received from Walmart this morning regarding the article I received from them in response to this article written about them only this morning. They also attached the following complaint, which can be found here.
Good morning Mr. Ostler.As I was scanning coverage of Walmart this morning, I came across the article below written by “scott.”As your audience appears to be a those based in the law, I was concerned about the presumptions made that were not attributed nor based in fact.
- In the opening graph, “scott” references “the long-time dispute between Wal-Mart and its employees.” We have more than 1.3 million associates in the U.S. and, based on survey data, nearly 90% of our associates would recommend working at Walmart to a friend or relative. More than a quarter million of our associates have been with the company for more than 10 years . Every year, we promote about 170,000 people to jobs with more responsibility and higher pay and more than 75 percent of our store management teams came up through the ranks of hourly associates at Walmart. I’m not sure where “scott” concludes there is any type of dispute between the company and the people who work for us.
- In the second graph, he references “a huge number of complaints before the labor board.” How many is that? And, of those, how many have been dismissed or withdrawn vs. upheld. And, for context, how many ULPs have been filed over the past 4-5 years against the UFCW compared to Walmart?
- The second graph is also factually incorrect as we filed a ULP against the union and its OUR Walmart subsidiary in November which led to a January settlement agreement between the UFCW and the NLRB whereby the union agreed to stop picketing and other confrontational behavior for 60 days.
- The Florida lawsuit is not a free speech case, it is a property rights case. We have made multiple requests for the union to stop illegally trespassing onto our private property. They continue to do it and frequently we have to get the police to get them to leave. In the lawsuit filing, it specifically notes that there have been “at least 30 separate trespass warrants issued by local authorities…” In a letter to the UFCW, our counsel notes at least 73 trespass violations occurring in the past year at our facilities. The suit seeks a permanent injunction. I’ve attached it for your convenience.
