Justice Dept. Lawyer Caught Using Personal Email to Send Sensitive Government Work

Hillary Clinton is not the only one in hot water over using a personal email account. A Justice Department lawyer has admitted to sending sensitive information to her personal account. The information was not classified but still should not have been handled so carelessly.

Federal workers can expect professional and legal ramifications for mixing their work for the government with personal and unsecure email accounts. Just as Clinton is facing scrutiny for her actions, the investigation by the inspector general outlined multiple policy violations and recommendations to the Office of Professional Responsibility, which handles allegations of lawyer misconduct.

The investigation into the lawyer began two years ago after the FBI raised concerns that sensitive information may have been disclosed. The result of the investigation determined that the lawyer had indeed improperly shared information such as draft proceedings from her government computer to her personal account, violating the Justice Department’s policy of prohibiting the transmission of sensitive information over the internet unless encrypted.

The lawyer was also found to have used Justice Department letterhead to write a letter of recommendation for her niece and also performed pro bono legal work without authorization. While the attorney is not named it is clear in the report that the issue happened with an assistant U.S. attorney in the Southern District of Texas.

The lawyer had told investigators that she regularly sent work to her Yahoo account “all the time” so she could work from home. She thought her supervisors were aware of this and had even encouraged other coworkers to send her work when she was home sick.

Justice Department spokesman Wyn Hornbuckle simply stated, “Appropriate action was taken on the basis of the referral.”
