Daniel C. Brauweiler, the man who was the Special Trial Counsel on Tax Controversies for Entergy Services Inc., since 1999, has returned to private practice and joined Vinson & Elkins as Counsel In Houston. Brauweiler is well-known for his knowledge and expertise in handling tax controversy matters and complex federal tax matters both for the IRS and for corporate taxpayers.
Brauweiler is the second tax controversy attorney to join V&E in recent weeks. The firm also added Partner Sheri Dillon in Washington, D.C. Dillon represents clients in federal tax controversy matters, with a particular focus on partnership tax issues for REITs, hedge/private equity funds, multinationals and high net worth individuals and their business interests.
Among his high-profile cases, Brauweiler helped Entergy win a landmark foreign tax credit case in the U.S. Tax Court and at the 5th U.S. Circuit Court of Appeals. He had a leading role in setting the precedent of Entergy Corporation v. Commissioner, 683 F. 3d 233 (5th Cir. 2012). He readied the case for trial, procured expert witnesses in London, briefed the trial judge and later the 5th Circuit on the issues, and with about $250 million on stake for Entergy, he helped the company obtain a foreign tax credit for taxes paid by its UK subsidiary. Brauweiler also helped prepare Entergy’s amicus brief in a similar matter to the U.S. Supreme Court that led to reversal of a decision earlier made by the 3rd Circuit.
