U.S. Attorney Joe Hogsett remains a bit of a mystery, full of undisclosed motives and goals. After all, he claimed last January his intention to serve a full term as U.S. Attorney for the Southern District of Indiana, which sails into the end of 2016. Instead, two weeks ago, he announced his resignation, leading many to suppose he intended to run for the Democratic nomination of Indianapolis’ mayoral election. As he has given no comment on that, or any of his other political plans, this much we know: his resignation is effective Thursday, and he will join the law firm Bose McKinney & Evans Friday.

“I am pleased to join the practice of Bose McKinney & Evans,” he said, as reported by indystar.com, continuing that they were “a firm that I have always respected and whose reputation for excellence in Indiana is well-known. Perhaps most importantly, I have been thoroughly impressed by this firm’s long history of active engagement in communities statewide.”

Perhaps that is something a mayoral hopeful would say? Or perhaps he is simply eager to put his JD from Indiana University School of Law, and his membership with the Indianapolis Bar Association, the Indiana State Bar Association, the American Bar Association, and the Federal Bar Association to use in the private sector. Certainly firms have long appreciated the unique experience federal attorneys offer.

“Joe is an extremely accomplished attorney and we are thrilled to have him join our firm where his tremendous talents will be utilized to assist our clients,” said Bose managing partner Jeffrey R. Gaither in a prepared statement.

The future seems wide open to somebody with his wealth of experience, so while it might be difficult to determine where he hopes to end up, when, and how, that he can do so we can feel assured of.

Attorney Barred For Sending Horror Film Clip

The circulation of a nude scene seemingly featuring a former co-worker led to one Indiana attorney’s suspension for three years. Arthur J. Usher, a former partner at Bose, McKinney & Evans, LLP, attempted to ridicule both Bose and their newest hire by sending a R-rated clip from a horror film in which the new hire had acted to the a wide swath of Indiana attorneys. Usher was sentenced to a three year suspension for practicing law by the Indiana Supreme Court, for what justices said was a “mean-spirited and vindictive attempt to embarrass and harm” an attorney who had rejected his romantic advances.

While Usher was a partner at Bose, Suzanna Hartzell-Baird joined the firm as an intern. Usher worked with Hartzell-Baird, and attempted to start a romantic relationship with her, which she resisted. After Hartzell-Baird was hired as an attorney at the firm, Usher discovered that she had acted in a low-budget horror movie in which she seemed to appear nude. Though Hartzell-Baird actually did not appear nude through the use of a body-double, Usher shared the clip with other attorneys at the firm under the pretense that it was indeed the firm’s new hire.

The Wall Street Journal reports that when Hartzell-Baird learned that Usher was showing the clip to other attorneys in the office, she threatened him with a restraining order. Later, Usher worked with a paralegal to create a fake message board posting that included the video clip, and sent it to more than fifty attorneys throughout Indiana with the subject line “Bose means Snuff Porn Film Business.”

Hartzell-Baird filed a grievance with the Indiana Supreme Court Disciplinary Commission and also sued Usher. The lawsuit was settled, and the commission ruled that Usher committed attorney misconduct by engaging in a pervasive pattern of dishonesty and misrepresentation, and he is now barred from practicing In Indiana for the next three years. Usher left Bose around the time that email was sent, and since the lawsuit and complaint were filed, was let go from his subsequent position.

“I’m happy that the interest of justice was served,” Hartzell-Baird told the Wall Street Journal.

Tabbert Hahn Earnest & Weddle, a mid-sized law firm based in Indianapolis that has government, lobbying and pharmaceutical practices, is now slowly dissolving after more than 20 years of existence in the legal industry. The Indianapolis Business Journal revealed that the firm will close at the end of the year, though an actual date has not yet been finalized, so many of its lawyers and staffers are leaving to transfer to a much bigger firm in the city. There are five partners and four associates who are slated to join Bose McKinney & Evans in 2011. The lawyers who will jump to Bose are: named partners Gregory Hahn and Robert Weddle, partners Matthew W. Conner, Mary M. Ruth Feldhake, and Chad T. Walker. Meanwhile, the four associates are the following: David J. Duncan, Joel T. Nagle, Kevin M. Quinn and Elizabeth Schuerman.

Named partner Gregory Hahn expressed his excitement over the move. He described the firm’s decision as more of a business combination rather than a merger. “Overall as a law firm, we have a number of national and international clients and this just gives us a bigger platform to represent those interests. I’m very excited about this. They’re great lawyers and have a great reputation, and this combo will help everyone go to a bigger plateau.”

Bose spokesman Roger Harvey confirmed that nine attorneys would be joining their firm. He added that their firm circulated a company-wide e-mail informing the current staff and lawyers about the new hires and the latest changes in their company.
