Congress voted today to cut funding for National Public Radio in a mostly party line vote.  House Republicans said the move was not an ideological attack on NPR, which is viewed by most conservatives as a bastion for liberalism, but rather a fiscal necessity in a time when the government needs to get its monetary house in order.  However that didn’t stop House Majority Leader Eric Cantor of Virgina from asking “…why should we allow taxpayer dollars to be used to advocate one ideology?”

The measure faces almost certain defeat in the Democrat controlled Senate and even if it were to pass through both chambers the President has firmly stated his opposition to de-funding public radio.

It was bound to happen.  As the economy tanked and jobs for recent graduates fell, law school admissions continued to rise, leading to a glut in the legal job market.  The result was numerous articles and blogs begging students to think twice before jumping into law school.  Those words of warning seem to have finally had an impact.

New applications for law school are down 11.5% this year, to just under 67,000 – the lowest number since 2001.  But it may not be entirely attributable to a depressed legal job market.  As the economy improves, there are more jobs available for college graduates without advanced degrees making the prospect of joining the work force now more appealing, rather than racking up another hundred thousand dollars or so in student loans.

Baker BottsBaker Botts picked up 32 antitrust lawyers from the remains of Howrey, including nine partners.  The team will work out of the firm’s Washington DC office.  Seven of the former Howrey partners will be partners at Baker Botts and the other two will be of counsel.

Included in the group is Sean Boland, former vice-chair of Howrey, and two former assistant US attorneys general who will both serve as senior counselors at their new firm.  Boland led Howrey’s negotiation discussions with Winston & Strawn and said that one of the reasons the deal fell through is that client conflicts would have split up his anti-trust group.

nalpAccording to NALP, the job market for new grads is edging back upwards after two years of falling indicators, but has not yet returned to pre-recession numbers.  In a press release issued today, NALP said the new numbers reflected a “…soft bounce in the market.”

The biggest gainer was the job offer rates for summer interns, which shot up 18% to 87.4%.  A large improvement to be sure, but still below 2008’s 89.9%.  And even though the percent of summer interns being offered a job is increasing, the overall number of interns is still down, with a national average of 9 interns compared to the highwater mark of 15 set in 2007.  The good news is that this is still an improvement over the 7 interns per firm in 2009.

Sukhjinder Basra is a Sikhserving time in California’s prison system for a drug offense.  As an article of faith, Basra has a full grown beard and has refused to shave it off in compliance with prison regulations, which stipulate that an inmate may have no longer than a half inch of facial hair.  As a result of violating the rules, he has been assigned extra prison duties, been confined to his bunk for 10 days and had 30 days of good behaviour removed from his prison record. 

First the ACLU protested his treatment and now the Department of Justice has taken on the case by bringing a lawsuit against the Department of Corrections and Governor Jerry Brown under the Religious Land Use and Institutionalized Persons Act of 2000. According to the DOJ, the prison’s grooming policy “…substantially burdens the rights of an inmate to practice his Sikh faith.”

The annual list of top law schools from US News & World Report is out, and the only major surprise this year is the way it was formatted.  Rather than stop the numerical ranking of schools at 100 followed by alphabetical listings of what they deemed third and fourth tier schools, the new listing extends out to 145 numerically ranked law schools and an alphabetized final tier of 45. 

Nothing changed in the top five compared to last year’s rankings.  Yale, Harvard and Stanford still lead off the list.  Within the top 10, Michigan and Berkeley swapped spots, taking the 7th and 9th slots respectively, and the University of Virginia moved from 10th to a tie for 9th.

Clifford ChanceFollowing a trend started by US firms, Clifford Chance  has become the third “magic circle” firm to pay a spring bonus to its US associates.  The bonus, announced last week, will be paid to US associates in New York and Washington DC, based on seniority and performance.  At the low end, the bonus is lower than rival UK firms Freshfields and Linklaters .  Clifford Chance is starting the bonus scale at $2,500, compared to Linklaters $7,500.  The top end amount is the same, at $20,000, however associates with three years less experience will qualify for the top end bonus at Clifford Chance compared to the other two firms.

HowreyAfter last week’s decision to shutter the firm, more Howrey partners are making an early exit.  Since the dissolution vote, Venable,  Covington & Burling, and Arnold & Porter have all picked up partners.

The largest group went to Arnold & Porter who snagged a 13 lawyer IP litigation team, split between Washington, DC and LA.  The team is made up of five partners and one of counsel, all of whom will join Arnold & Porter as of counsel, along with seven associates.

The partnership vote, which happened last week on the 9th, requires partners who were still at the firm as of that day to remain until the dissolution on the 15th.  Any moves happening between the 9th and the 15th will not become official until Wednesday at the earliest.

HowreyIt’s official.  After months of bleeding partners and rumors about dissolution, the partnership of Howrey has voted to dissolve the firm, effective March 15.  According to a press release issued by the firm, a number of partners, associates and staff from the Houston office will join Winston & Strawn, while those with significant client conflicts will be moving to other AM100 firms.

One things for certain: wherever they end up, they’re likely to find old friends.  In the last year, over 140 partners have left Howrey for other firms, not to mention large numbers of associates and staff.  As they say at Dodger Stadium, you can’t know the players without a scorecard, and The American Lawyer has prepared a handy chart for those interested in tracking the former Howrey partners.

Even a major law firm needs lawyers when it shuts its doors, and Howrey is no exception.  The firm will be advised during the final days by counsel from Latham & Watkins.

For three weeks, the Wisconsin Senate has been unable to take action on a controversial measure that strips public employee unions of many rights and powers because Senate Democrats fled to Illinois in a procedural move to deny quorum.  However, today the Senate managed to get around that by removing the financial portions of the bill, and bills that don’t involve spending have a lower quorum threshold.

The new law strips public employee unions of the right collectively bargain for anything other than wages, while capping raises at the rate of inflation.  It also requires them to cover a larger percentage of their pension accounts and health care premiums, and it prohibits unions from having mandatory membership with dues deducted from paychecks.
