Lindsay Lohan’s Grand Theft Auto 5 Lawsuit Dismissed

Summary: Lindsay Lohan’s lawsuit against the makers of Grand Theft Auto V has been dismissed.

Litigious actress Lindsay Lohan sued the makers of Grand Theft Auto V in 2014. She said that its publisher, Take Two, created a character using her likeness without her permission, and on Thursday, a panel of New York Judges dismissed her case, saying it was without merit.

The five-judge panel said that the lawsuit was meritless because the game did not violate Lohan’s privacy because it did not use her name and likeness. They added that even if Take Two was inspired by Lohan the game’s “unique story, characters, dialogue, and environment, combined with the player’s ability to choose how to proceed in the game, render it a work of fiction and satire.” Thus, their work was protected by the First Amendment.

Lohan filed the lawsuit in 2014, and in March of 2016, the case was allowed to move forward in court. She sued Take Two and its subsidiary Rockstar Games.

Lohan alleged that the Grand Theft Auto V character Lacey Jonas was a replica of her likeness. Lacey Jonas lived in the Chateau Marmont, where Lohan famously stayed, and the character was an abrasive and self-centered actress. The character was also busty and posed in a bikini with a peace sign, which Lohan claimed was a rip off of her style.

Take Two responded to Lohan’s lawsuit earlier and said the suit lacked good faith and was intended to garner the starlet publicity. The company added that Lohan also had a history of filing frivolous lawsuits.

To recap, in addition to suing Take Two, Lohan had lost a defamation lawsuit against Fox News and had unsuccessfully sued musician Pit Bull for calling her out in a song.

Mob Wives star Karen Gravano filed a similar lawsuit against the game makers, and that case was also dismissed.
