Summary: Texas and ten other states are suing the federal government for imposing a directive that forces schools to allow transgender students and anyone to use the public facilities of their choice.
Eleven states have filed a lawsuit against the Obama administration for its transgender bathroom directive. Texas is leading the way with ten other states to fight against the order to allow students to use the facilities of their choice.
The lawsuit has been filed in a Texas federal court just weeks after Obama gave the order saying transgender students can use bathrooms and locker rooms that match their gender identity. Texas Attorney General Ken Paxton argues that the directive is an attempt to rewrite the law. He explained “this represents just the latest example of the current administration’s attempts to accomplish by executive fiat what they couldn’t accomplish through the democratic process in Congress.”
The other states joining in the lawsuit are Alabama, Arizona, Georgia, Louisiana, Maine, Oklahoma, Tennessee, Utah, West Virginia, and Wisconsin.

The words of the lawsuit read, “Defendants have conspired to turn workplaces and educational settings across the country into laboratories for massive social experiment, flouting the democratic process, and running roughshod over commonsense policies protecting children and basic privacy rights.”
Obama has threatened states that do not comply with the order with a loss of funding but Texas has said they are willing to forfeit their $10 billion in federal education dollars.
North Carolina is currently deep in a lawsuit against the Justice Department for their transgender law prohibiting transgender people from using any bathroom except the one that matches their biological sex on their birth certificate.
