Some attorneys may be guilty of blowing off court once in a while, but Marc Daffner, an attorney from Pittsburgh, put in a request for a continuance on Thursday that could not be denied.
According to TribLive.com, Daffner requested a postponement of his client’s preliminary hearing Thursday morning, which was to be held at the Pittsburgh City Court. The request read, “Defense counsel’s wife went into labor at approximately 11:15 a.m. today, and defense counsel will be killed by his wife if he does not get to the hospital immediately.”
Randi, Daffner’s wife, was at a doctor’s appointment Thursday morning when she was informed it was time to deliver. Randi was taken to the hospital immediately.

Daffner commented, “They say you need to be truthful to the court. I didn’t have a legal reason for the continuance, but that was the truth. I got a new date, and the DA signed off on it.”
Judge Jeffrey A. Manning said he “could not imagine” a judge not granting a continuance if an attorney’s wife was about to give birth. “It’s a significant emergency,” he remarked.
Loti Mbewe was supposed to have his preliminary hearing for his charge of receiving stolen property. Unfortunately for him, he will remain in Allegheny County Jail until the rescheduled date of September 2 if he cannot post bail.
Brynn Daffner was welcomed to the family at 12:57 a.m. Friday morning, at a healthy 7 pounds and 9 ounces.
