Lawsuit Against Wal-Mart from Tracy Morgan Moves to Court

Summary: The lawsuit filed against Wal-Mart by comedian Tracy Morgan following a deadly accident this summer has moved to court.

On Tuesday, attorneys were scheduled to meet in federal court for a hearing regarding comedian Tracy Morgan’s lawsuit filed against Wal-Mart, according to The Globe and Mail.

The lawsuit stems from a fatal accident that occurred on the New Jersey Turnpike this past summer. The accident was caused by a Wal-Mart truck.

The truck crashed into the rear of a limo van that was carrying Morgan and others on the Turnpike as they returned from a show in Delaware. James McNair, another comedian, was killed in the accident.

Morgan suffered broken ribs and a broken leg. He spent weeks in the hospital and a rehab facility prior to going home. Three other people were hurt in the accident, which two injuries being called serious.

Morgan filed the lawsuit asking for compensatory and punitive damages. Wal-Mart said that the injuries to the victims were partly caused by the fact that they were not wearing seatbelts.

Kevin Roper, who was driving the Wal-Mart truck, is not named in the lawsuit filed by Morgan. He has been charged with death by auto and four counts of assault by auto in New Jersey state court.

Roper filed to have the Morgan lawsuit delayed until his case proceeds. A hearing on this issue will be held in the middle of December.

The National Transportation Safety Board released a report in June that found Roper was driving 65 MPH in the one minute leading up to the accident. The speed limit on the stretch of the Turnpike where the accident occurred is 55 MPH and was dropped to 45 MPH because of construction.
