Red Bull Gives You Money

Summary: Pending final approval of a settlement, Red Bull will pay consumers $10 in cash or $15 in Red Bull products if they purchased Red Bull in the past ten years as retribution for alleged false advertising.

Sadly, Red Bull doesn’t “give you wings.” The famous slogan “Red Bull gives you wings” has landed the energy drink company in trouble, the Huffington Post reports. Red Bull has agreed to pay over $13 million to settle claims in a class action lawsuit that accuses the drink company of false advertising. The settlement has not been approved on a final basis by courts, however, anyone who bought at least one can of Red Bull from January 1, 2002 to October 3, 2014 is eligible to receive $10 or $15 worth of Red Bull products. There’s no proof of purchase required.

Last year, consumer Benjamin Careathers filed the case in federal court in the Southern District of New York, claiming that Red Bull misrepresented the drink’s ability to boost performance and reaction speed. The complaint reads, “Even though there is a lack of genuine scientific support for a claim that Red Bull branded energy drinks provide any more benefit to a consumer than a cup of coffee, the Red Bull defendants persistently and pervasively market their product as a superior source of ‘energy’ worthy of a premium price over a cup of coffee or other sources of caffeine.”

The complaint continues, “Such deceptive conduct and practices mean that [Red Bull’s] advertising and marketing is not just ‘puffery,’ but is instead deceptive and fraudulent and is therefore actionable.”

Before the payouts can occur, the settlement has to be approved. The approval hearing is set to be heard May 1, 2015. Red Bull maintains its innocence in the suit. Its legal documents read, “Red Bull denies any and all wrongdoing or liability and maintains that its marketing and labeling have always been entirely truthful and accurate.”

So, while the drink may not give you wings, it’ll at least give you some cash. If you qualify, you can file a claim here.
