Burger King Sued for Attack Caused by Cold Onion Rings

Summary: The fast-food restaurant chain Burger King has been sued by a customer who was attacked by a store manager after complaining about cold onion rings.

At a Burger King in Bloomfield, New Mexico, a customer has accused the store manager of assault, according to a report from The New York Daily News.

The attack stemmed from cold onion rings and involved a Taser and a switchblade.

A lawsuit was filed against Burger King by Robert DeYapp last week after he claims the manager, Francisco Berrera, attacked him after requesting that his onion rings be re-heated.

The incident occurred on June 7, 2013.

According to the lawsuit, Berrera took the onion rings back and said the following in Spanish to a co-worker:

“This white boy is mad about his food, and he doesn’t even know that I’m going to return it and do whatever I want to it, and he’ll still eat it and never have any idea of what I did to his food.”

DeYapp understood what Berrera said and requested a refund, which was refused.

DeYapp said that Berrera took photos of him and his vehicle as he ate his meal. DeYapp asked Berrera what he was doing, which is when the manager “came around the counter and began lunging at Mr. DeYapp with a Taser in one hand and a switchblade knife in the other hand,” according to the lawsuit.

Berrera was arrested and pled guilty to felony assault with a deadly weapon. DeYapp was not injured during the attack, but he is looking for punitive damages for assault, negligent training and negligent hiring.
