Judge Gives Kerri Kasem Authority to Make Medical Decisions for Dad Casey

One of the most recognizable voices in America is in the middle of a court battle regarding his health. Casey Kasem’s daughter Kerri has the power to withhold fluids and food from her father, who is ailing, according to People.

The ruling was issued by Los Angeles Superior Court Judge Daniel S. Murphy, which reversed the decision from Monday that said the former radio host should be receiving food, fluids and medications until after a court-appointed attorney met with Kasem and his doctors.

On Wednesday, Murphy reviewed medical records and issued his ruling. Murphy concluded that Kasem would suffer more pain if he was given fluids or food, according to attorney Troy Martin, who represents Kerri. Martin also showed the judge documents that said Kasem did not want to be given food or fluids to prolong life if he was mentally incapacitated.

“It’s just flat-out wrong,” said Steve Haney. Haney is an attorney for Kasem’s wife Jean.

Haney claims that the ruling by Murphy came from an outdated document that stated Kasem’s wishes if he were to become mentally incapacitated. Haney noted that Kasem was still able to communicate nonverbally last week.

Jean Kasem pleaded with the judge to restore fluids and food to Casey, who is suffering from a form of dementia. Jean and step-daughter Kerri have been fighting over the health of Kasem since May.

Martin said that Kerri’s authority was upheld after Jean acted out of the realm of Casey’s best interests when she took him out of a medical facility in California in order to go to a friend’s home in Washington state.
Haney claims that Murphy’s comments about Jean’s decisions were wrong. Haney said Jean took Casey to Washington in order to be evaluated by a specialist.

Jean has been invited to the hospital by Kerri and her siblings Mike and Julie in order to be with Casey during his final moments.
