Former Chair of Brown Rudnick’s Real Estate Practice in NY Joins Arent Fox

Mark S. Fawer, the former chair of Brown Rudnick’s Real Estate Practice in New York has joined Arent Fox’s Real Estate practice along with another partner Carolyn Austin and associate Brandilyn Y. Dumas. The three attorneys are joining Arent Fox’s New York office and will focus on representing lenders, real estate developers, real estate investment trusts, private equity funds and other investors in the acquisition, disposition, financing and development of residential and commercial properties.

The arrival of the three real estate attorneys in New York follows on the heels of real estate finance partner David M. Martin joining in Washington, and real estate transactions partner M.J. Pritchett joining the San Francisco office of the firm.

Arent Fox’s Real Estate practice leader Kenneth S. Jacob said on the new hires, “Expanding on our nationally recognized real estate finance and transactional capabilities remains a focus for our group… The addition of Mark and Carolyn continues our recent growth in this area. Their sophisticated counsel to both borrowers and lenders on complex financing deals will be a great asset to our clients.”

At Brown Rudnick, Fawer focused on representing financial institutions and funds in preferred equity real estate financing transactions and restructurings, as well as intercreditor and securitized loan pooling and servicing disputes. Very recently, he had closed the restructuring of a $330 million senior loan secured by a portfolio of 11 branded and independent hotels located in six different states.

Fawer advises operating and capital partners in the structuring and negotiation of sophisticated partnership, joint venture, and limited liability company operating agreements. He also represents opportunistic buyers and sellers of a variety of real estate debt, including whole senior and mezzanine loans, syndicated and securitized interests, participations, landlords and tenants in commercial space, ground lease transactions, and hotel operators and owners in the negotiation of hotel management and franchise agreements.
