Former Radio DJ from New York Faces Sex Charges from Sting Operation

David Herman, a former New York City radio DJ appeared on Wednesday before US Magistrate Mark Falk to face charges of attempting to arrange sex with a 7-year-old. Herman tried multiple telephone and online conversations to arrange illegal sex with the child, believing he was communicating with the child’s 36-year-old mother.

But, it was a sting operation and neither the mother, nor the child existed, and there were federal investigators at the other side of the phone and internet.

Herman did not enter any guilty plea and his attorney contended that investigators goaded his client into implicating himself. He will be remaining in jail pending a bail hearing.

Assistant US Attorney Francisco Navarro told the court that the 77-year-old was a “severe danger to the community” and the government would oppose his bail.

He is charged with trying to transport a minor in interstate commerce with the intent of engaging in illegal sexual activity.

During his electronic communications both online and over the phone, Herman tried to arrange sex with the child in New York and New Jersey, and at one point became desperate enough to offer to fly the fictitious pair to St. Croix to have sex.

He went to the length of purchasing airline tickets to fly from LaGuardia, but when he arrived at the airport, he was picked up by special agents from the US Homeland Security and Immigration and Customs Enforcement.

Herman is a well-reputed DJ at the FM radio station WNEW in New York. His attorney said, Herman was only interested in the 36-year-old, but “There was an attempt by the investigator to get him to say things on tape to implicate himself.”

However, Herman’s attorney admitted that the undercover officers came into contact with Herman in an online chat room “that dealt mostly with incest.”
