Chief Claiming False Allegations

A request was made for Charles Daniels, Chief Justice, to avoid involvement with anything pertaining to the criminal charges that have been pressed against a judge in Las Cruces. While the request was made, Daniels claims that the request contains false allegations and is refusing to remove himself.

The request for Charles Daniels was that he be removed from the case against the judge in Las Cruces, Mike Murphy. The criminal charges against Murphy include witness intimidation as well as forms of bribery. Prosecutor Matt Chandler is the one who made the request to remove Daniels from the case. Chandler believes that it is not possible for Daniels to have involvement in the case without being one-sided or bias.

Daniels says the claims against him are completely false and are basically just a bunch of made up stories. However, Chandler believes differently. Chandler claims that Daniels made a worthless comment about the case going on against Murphy. Daniels is fighting back against the claims that Chandler has made. Daniels says that Chandler was listening in on telephone conversations that he was having with some of hist staff members.

While he admits to talking about the case, he said that the conversation had nothing to do with Murphy and was basically about his own self. Daniels also says that while he is expect to maintain an unbiased opinion or the case, he is allowed to think about the case outside of court. He believes there is absolutely nothing wrong with anything that he has done or said that would cause him to removed from the case. Daniels claims that he will continue to fight against being removed from the case because he believes Chandler’s allegations are false and ridiculous. He does not appreciate that Chandler has misinterpreted his comments and is misleading people into thinking he said something that he didn’t or was involved with something that he actually had nothing to do with.

Matt Chandler says, “I filed the motion in good faith asking Justice Daniels to examine whether he should recuse himself and we respect Justice Daniels’ ruling.” In the meantime, Daniel says he will not remove himself from the case due to speculation from Chandler about himself and his wife. He thinks it is ridiculous that Chandler and some others have spread fictitious rumors that claim he and his wife have paid millions of dollars for a seat on the bench during the case.

With all of this going on, Murphy is pleading not guilty to the criminal charges that have been pressed against him. He claims he is not guilty of intimidating any witnesses and that he has never bribed. The date of his trial is set for sometime in February of 2012.
