POSITION SUMMARY: This position reports directly to the Chief Compliance Officer and indirectly to the Outside General Counsel. The Litigation Specialist, in conjunction with the Compliance Paralegal, assists the Chief Compliance Officer and Outside General Counsel in managing the litigation caseload; investigating claims, preparing court pleadings for our litigation counsel; and assisting with the administration of the Compliance Management System (CMS) and other compliance initiatives as needed, including conducting audits of applicable federal and state laws. ESSENTIAL FUNCTIONS: · Supports the Chief Compliance Officer, Outside General Counsel, senior management and outside litigation attorneys in a litigation support capacity. · Drafts various pleadings, including answers, outbound discovery and responses to inbound discovery, for filing by local counsel in litigation proceedings. · Interacts with outside litigation and compliance attorneys as requested/required by the Chief Compliance Officer and/or Outside General Counsel. · Maintains current knowledge of applicable federal and state collection laws, including but not limited to the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Telephone Consumer Protection Act (TCPA), Health Insurance Portability and Accountability Act (HIPAA), Gramm-Leach Bliley Act (GLBA) and other applicable laws and analogous state and local laws. · Reviews company adherence to FDCPA, FCRA, TCPA, HIPAA, GLBA and other applicable laws. · Assists in the development, implementation, maintenance of and adherence to the company’s privacy principles, policies and procedures. · Communicates any non-conformances or opportunities for improvement to the Chief Compliance Officer on an ongoing basis. QUALIFICATIONS: Required Experience & Knowledge: Must possess knowledge of state and federal compliance laws and be familiar with the field’s concepts, practices, and procedures. 2-years’ experience in financial services or creditors’ rights setting preferred. Litigation experience and understanding of Federal and State Court rules required. Required Skills & Abilities: Must possess excellent communication and interpersonal skills. Must posses the ability to establish priorities and serve as a liaison with attorneys and external sources. Must possess the ability to conduct internet and other web based research. Should have a strong command of Microsoft Word, Excel, and PowerPoint. Coachable: receptive to feedback, willing to learn, embraces continuous improvement, and is receptive and responsive to change. EDUCATIONAL REQUIREMENTS: Juris Doctor preferred. Active bar membership not required. Must not have a record of any public discipline by any state licensing board.
