Profile

The Staff Attorney is responsible for managing the Fund’s delinquent contribution and withdrawal liability litigation, preparing and drafting plan and trust document amendments, administrative service agreements, disclosure documents, correspondence to participants and beneficiaries, and regulatory filings.  The Staff Attorney also will form an integral part of the Fund’s benefit claims process.  The Staff Attorney should also be comfortable in a sometimes fast-paced, demanding environment. 

ESSENTIAL FUNCTIONS COULD INCLUDE:

  • Prepares demand letters and draft complaints.
  • Complete litigation-related tasks, including the referral of a matter to outside legal counsel.
  • Responds to employers’ or employers’ attorneys’ communications.
  • Reviews bankruptcy notices and takes any bankruptcy related actions.
  • Oversees all collections matters order to effectively resolve collections matters.
  • Prepares and coordinates Board meeting reports and presentations in accordance with the deadlines established around the Board meetings.
  • Corresponds with outside legal counsel about pending litigation matters, reviews draft motions, complaints, affidavits, settlement agreements, etc. that are prepared by outside legal counsel, and negotiates settlements with delinquent employers.
  • Provides counsel with the application of and compliance with the Internal Revenue Code and the Employee Retirement Income Security Act as pertains to retirement and other employee benefit plans, programs and arrangements.
  • Reviews and revises QDRO procedures and assists in administration of procedures.
  • Maintains and supports a culture of legal compliance.

EDUCATION, EXPERIENCE AND SKILLS:

  1. Law degree from an accredited law school and 1+ years of relevant experience, including complex ERISA and tax-qualification experience or litigation experience.
  2. Admitted to the bar in Virginia or eligible to waive in within first year of employment.
  3. Initiative, integrity, resilience, and ability to manage multiple projects at the same time.
  4. Demonstrated ability to communicate clearly and concisely.
  5. High level of analytical and problem-solving skills.
  6. Superior organizational ability and time management skills.
  7. Ability to work self-sufficiently in a dynamic and fast-paced environment.
  8. Desire to work in a team-oriented, collaborative environment.
  9. Ability to manage outside counsel relationships.
  10. Must be proactive and anticipate client needs and concerns.
  11. Experience with benefit claims and appeals a plus.
  12. Knowledge of defined benefit pension plans, with multiemployer plan experience (including the special funding rules applicable to multiemployer pension plans) a plus.
  13. Knowledge of employment/labor law a plus.
  14. Knowledge of the tax qualification requirements of the Internal Revenue Code and ERISA as pertains to employee benefit plans and programs a plus.
