<p>Duane Morris announced recently David A. Charapp has joined the firm as a partner in its San Diego office, in its Corporate Practice Group. In addition, the firm is also pleased to welcome Jarrett Fugh as a partner in its Los Angeles and San Francisco offices. Fugh joins the Real Estate Practice Group.</p>
<p>The addition of Charapp reflects the firm’s growing corporate practice group on the West Coast and nationally, especially in the areas of life sciences and technology. He joins Duane Morris from Foley &amp; Lardner LLP. There, he served as chair of the firm&#8217;s Life Sciences Collaborations &amp; Licensing Practice.</p>
<p>Charapp assists life sciences and technology companies with their critical partnering, licensing and financing transactions, as well as significant operational agreements such as those for manufacturing and supply, distribution, and pre-clinical and clinical research. Charapp has significant experience as an in-house attorney, having been associate general counsel at Kosan Biosciences, a biotechnology company acquired by Bristol-Myers Squibb, and associate general counsel at Santarus, a specialty biopharmaceutical company.</p>
<p>Charapp earned his J.D., magna cum laude, Order of the Coif, from Boston College Law School.</p>
<p>Duane Morris&#8217; Life Sciences and Biotechnology Group offers clients a wide range of legal services, including intellectual property counsel, securities counsel in connection with private and public equity funding, international trade and tax advice, labor and employment guidance, dispute resolution and litigation service. These are all provided within the framework of their business to address each client&#8217;s specific needs.</p>
<p>The addition of Jarrett Fugh reflects the firm’s growing Real Estate Practice Group on the West Coast and nationally. He joins Duane Morris from Winston &amp; Strawn.</p>
<p>Fugh concentrates his practice on real estate and corporate matters, representing clients in the acquisition, financing, development and leasing of real property, with an emphasis on hospitality and resorts. He helps clients in the origination and restructuring of syndicated, mezzanine and securitized loans, as well as in the construction financing of major commercial, residential and hospitality properties. In addition, Fugh advises clients on the formation and structuring of joint ventures for both developers and institutional investors in real estate projects. He also counsels clients on a range of general corporate matters, including mergers and acquisitions and financings.</p>
<p>Local and national media have interviewed Fugh with regard to economic trends in the real estate market, particularly those concerning Asian investment in the U.S. real estate markets.</p>
<p>Fugh earned his J.D., cum laude from The George Washington University Law School, where he was a staff member of The George Washington Journal of International Law and Economics.</p>

<p>Fenwick &amp; West LLP announced in recent days that high stakes IP litigation attorney Andrew P. Bridges has joined the firm as a partner in its IP &amp; Technology Litigation group.</p>
<p>Bridges concentrates his practice on complex litigation in Internet, copyright, trademark, advertising, unfair competition, consumer protection and commercial law disputes. He is recognized on a regular basis as one of the Top 100 IP litigators in California. He joins the firm from the San Francisco office of Winston &amp; Strawn. According to Corporate Counsel, he is one of the Top 10 “Go-To” IP litigation firms in the U.S.</p>
<p>Laurence Pulgram, Co-Chair of the firm’s IP &amp; Technology Litigation Group was quoted as saying in a press release at the firm’s website: “Fenwick continues to seek out the best attorneys to deepen practice areas that are mission critical to our technology and life sciences clients. <p>Bridges litigates cases for Internet, technology, and consumer-focused companies with regard to new business models, media, technologies and communications platforms. He has handled numerous high-profile matters, including the defense of Diamond Multimedia against the recording industry&#8217;s attack on the first popular portable MP3 music player; defense of Google and others against Perfect 10&#8242;s copyright, trademark and publicity law challenges to the Internet; CNET Networks against the effort of Snap-On Tools to thwart the launch of the Snap! Online portal; and ClearPlay, maker of DVD playback control software that enables consumers to have a &#8220;PG&#8221; experience of &#8220;R&#8221; rated movies, in a suit brought by Hollywood directors and studios seeking to ban the software.</p>
<p>Bridges has secured numerous settlements for clients in important cases, including ones for The Financial Times Limited, Bare Escentuals, OmniVision Technologies, Cox Communications, Full Sail University.</p>

The World Intellectual Property Organization’s Mediation and Arbitration Center has selected him as a domain name arbitrator, and he serves the U.S. District Court for the Northern District of California as an early neutral evaluator.</p>

<p>Winston &amp; Strawn LLP announced in recent days it has added Alfred Fabricant and Lawrence Drucker as partners to its New York office. Fabricant will head the firm’s IP practice in New York.</p>
<p>Both attorneys join from Dickstein Shapiro, LLP.  Both have cultivated a robust IP litigation practice through their representation of clients in cutting-edge technologies related to software used for analyzing media audience and marketing information data, radio frequency identification, digital watermarking, robotics, optics, and Web design platforms. Their clients are based in the United States, Europe, and Asia.</p>
<p>Fabricant has over thirty years of litigation experience. He is an experienced trial lawyer, and concentrates his practice on patent, copyright, trademark, unfair competition, entertainment, antitrust, and other commercial litigation matters. He has, on behalf of both plaintiffs and defendants, tried cases to verdict as first chair in a broad range of technical disciplines, including digital and analog electronics, robotics, computer software, mechanical, chemical, pharmaceutical, and business method patents.</p>
<p>For twenty years, Drucker has concentrated his practice on patent, trademark, and copyright litigation, including trials and appeals. His work covers a broad range of areas, and includes patent infringement matters involving consumer electronics, audience measurement systems, medical devices, robotics, optics, radio frequency identification products, and floor coverings.</p>
<p>Michael Elkin, managing partner of Winston&#8217;s New York office was quoted as saying in a press release at the firm’s website: “Fred and Larry bring enormous talent and energy to our IP litigation practice. Their nuanced understanding of advanced technologies, plus their track record of success in the courtroom, are tremendous assets to existing and new clients in New York.”</p>

<p>Fabricant earned his J.D., with highest distinction, from The John Marshall Law School in 1978 and his B.A. in Political Science, magna cum laude, from the University of Miami. Drucker earned his J.D. from Columbia Law School in 1988 and his B.A. in Economics and Political Science, summa cum laude, from Queens College of the City University of New York.</p>
<p>The addition of Fabricant and Drucker follows the firm’s recent expansion of its global intellectual property litigation group and regional capabilities. Most recently, Winston added prominent IP litigation attorney Michael Murray to its New York office. As well, David Enzminger and David Dalke joined the firm&#8217;s Los Angeles office. In addition over fifteen litigation partners from the former Howrey law firm joined its Chicago and Washington, D.C. offices, as well as its newly opened Houston office.</p>

<p>Winston &amp; Strawn LLP announced yesterday that Michael Madden has joined the firm as head of its commercial litigation practice in London.</p>
<p>The addition of Madden follows a succession of high profile appointments for Winston, both in London and globally. As part of its continuing strategy for expanding globally, prominent IP litigators, Richard Price and Gareth Morgan, joined the firm’s London office. In addition, other major hires include former managing partner/CEO of Howrey LLP, Robert Ruyak, and former head of the President&#8217;s national Financial Fraud Enforcement Task Force, Robb Adkins, to the firm’s Washington, D.C. and West Coast offices. </p>
<p>Madden is the former managing partner of Ashurst&#8217;s dispute resolution department. Not only does he have a strong track record in commercial litigation and arbitration, administrative law and judicial review, he has significant experience as the lead partner in disputes involving corporate acquisitions, divestitures and joint ventures in various industries. He has also advised on disputes relating to international and domestic contracts, finance transactions, tax, defamation, professional negligence, insolvency issues and real estate.</p>
<p>Among Madden’s range of significant cases is a favorable decision before the House of Lords concerning directors&#8217; duties which is a leading case on the use of &#8220;poison pill&#8221; and other takeover disputes. He has successfully handled many other major cases in the Court of Appeal and the High Court, including leading cases on injunctions, the exercise of public authority powers and on casino licensing. </p>
<p>Madden’s corporate clients represent a variety of sectors, including banks, private equity, financial services, retail, gaming and leisure, real estate and technology. He is consistently recommended for his strong client focus. He has been described, per the press release, in the leading directories as “someone you would always want on your side” and a “tough” litigator.</p>
<p>While serving as managing partner of the Ashurst dispute team, Madden oversaw the development of litigation and arbitration teams to service global clients, including the establishment of such practices in Europe, Singapore and Hong Kong, and with clients and lawyers in Beijing and other centres in China.</p>
<p>Winston’s managing partner, Thomas Fitzgerald was quoted as saying in a press release at the firm’s website: “We are delighted that Michael has chosen Winston to further develop his highly regarded disputes resolution practice. Michael&#8217;s experience and stature within the sector will immediately enhance our dispute resolution capabilities and undoubtedly attract the kind of talent we seek in growing our presence throughout Europe.”</p>
<p>Madden was quoted as saying: “Winston&#8217;s globally acclaimed disputes resolution team has an outstanding reputation and a premier list of clients. I am pleased to be joining the Winston London office at a time of growth and welcome the exciting new challenge of developing not only a London-based disputes resolution team but a truly global offering.”</p>

<p>Included in the group is Sean Boland, former vice-chair of Howrey, and two former assistant US attorneys general who will both serve as senior counselors at their new firm.  Boland led Howrey&#8217;s negotiation discussions with Winston &amp; Strawn and said that one of the reasons the deal fell through is that client conflicts would have split up his anti-trust group.</p>

			<content:encoded><![CDATA[<p><a href="http://www.jdjournal.com/wp-content/uploads/2009/04/howrey_160x120.jpg"><img class="alignright size-full wp-image-11132" title="howrey_160x120" src="http://www.jdjournal.com/wp-content/uploads/2009/04/howrey_160x120.jpg" alt="Howrey" width="160" height="120" /></a>It&#8217;s official.  After months of bleeding partners and <a href="http://www.jdjournal.com/2011/03/09/more-lawyers-leave-as-howrey-dissolution-vote-approaches/">rumors about dissolution</a>, the partnership of Howrey has voted to dissolve the firm, effective March 15.  According to a press release issued by the firm, a number of partners, associates and staff from the Houston office will join <a href="http://www.winston.com/">Winston &amp; Strawn</a>, while those with significant client conflicts will be moving to other AM100 firms.</p>
<p>One things for certain: wherever they end up, they&#8217;re likely to find old friends.  In the last year, over 140 partners have left Howrey for other firms, not to mention large numbers of associates and staff.  As they say at Dodger Stadium, you can&#8217;t know the players without a scorecard, and The American Lawyer has prepared <a href="http://www.law.com/jsp/tal/PubArticleTAL.jsp?id=1202484473866">a handy chart</a> for those interested in tracking the former Howrey partners.</p>
<p>Even a major law firm needs lawyers when it shuts its doors, and Howrey is no exception.  The firm will be advised during the final days by counsel from <a href="http://lw.com/">Latham &amp; Watkins</a>.</p>

			<content:encoded><![CDATA[<p>As the dissolution vote draws nearer, and is reported to be happening this week, partners are<a href="http://www.jdjournal.com/wp-content/uploads/2009/04/howrey_160x120.jpg"><img class="alignright size-full wp-image-11132" title="howrey_160x120" src="http://www.jdjournal.com/wp-content/uploads/2009/04/howrey_160x120.jpg" alt="Howrey" width="160" height="120" /></a> continuing to leave the firm.</p>
<p>Four IP litigation partners from Howrey’s Palo Alo office are now moving to Perkins Coie.  The four who are leaving are James Valentine, Daniel Shvodian, Christopher Kelley, and James Pistorino, all from Howrey’s Palo   Alto office.  Margaret Macdonald, another partner of Howrey located in Washington D.C., has also been given an offer by Perkins Coie, according to Perkins Coie’s chief lateral recruitment officer, Karen Andersen.</p>
<p>Since these four jumped ship, Perkins Coie has increased its IP practice to over 75 patent litigators and over 200 attorneys in its Bay area location, according to its Bay area managing partner, Ed Wes.</p>
<p>Krista Carter, also based in Howrey’s Palo Alto office, left Howrey for Dickstein Shapiro.  On March 1<sup>st</sup> she joined the firm and now is opening an office in Silicon  Valley, along with partners Deborah Fishman and Jeffrey Miller, who were formerly partners at Orrick, Herrington &amp; Sutcliffe.</p>
<p>Henry Petri and Janelle Waack, from Howrey’s Houston firm, left for Novak Druce + Quigg, an intellectual property firm, originally founded in 2004 by partners formerly from Howrey.  Howrey’s Houston office has not seen as many defections as some of its other offices, and Petri was offered a position at Novak in January, but, in his words, he stayed until now “to wrap up things there.”</p>
<p>Waack decided to move much more recently, because of the talks between Howrey and Winston.  In her own words, she said, “When the situation came up with Howrey and the potential integration with Winston &amp; Strawn, it just became apparent there were some conflict issues I’d have to deal with.”</p>
<p>As a result of all of the recent departures, Howrey is now almost the half the size it was last year.  The firm had 297 partners and counsel as of April 2010.  Now, less than a year has passed by, and 141 of those 297 have left the firm.</p>

<p>Large numbers of Howrey partners have moved to other firms in the last few months after merger talks with Winston &amp; Strawn fell through.  Winston &amp; Strawn reportedly withdrew from merger negotiations and instead issued direct invitations to three-quarters of Howrey partners, however several prominent attorneys have left for firms other than Winston as well.</p>

			<content:encoded><![CDATA[<p><a href="http://www.jdjournal.com/wp-content/uploads/2009/04/howrey_160x120.jpg"><img class="alignright size-full wp-image-11132" title="howrey_160x120" src="http://www.jdjournal.com/wp-content/uploads/2009/04/howrey_160x120.jpg" alt="Howrey" width="160" height="120" /></a>Five lawyers in Chicago and six in Southern California have left Howrey and joined up with Morgan Lewis.  In Chicago, managing partner David Clough, along with Kenneth Kliebard, the class action practice group leader, and litigator Scott Schutte were joined by two associates as they moved to Morgan Lewis.  On monday, partners Robert Gooding Jr. and Scott Garner along with four associates in Irvine, California, joined Morgan Lewis.</p>
<p>According to numerous reports, Winston &amp; Strawn, after ending merger negotiations with Howrey, made individual offers to as many as three quarters of Howrey partners over the weekend.</p>

Murray joined Winston &amp; Strawn’s intellectual property litigation practice, which currently has about 26 lawyers at its New York office and over 140 firmwide. Murray, a graduate of Georgetown University Law Center, has been an IP litigator for more than 25 years representing clients on various strategies for developing intellectual property assets, licensing and patentability of technology, patent infringement and enforcement issues.</p>
<p>Michael Elkin, managing partner of Winston’s New York office, said that Murray’s solid experience in the IP practice will bolster the firm’s highly-ranked IP group. “Mike brings enormous talent and high energy to our IP litigation practice. His vast experience understanding complex IP issues, along with his track record of success in the courtroom, will be an immediate asset.”</p>
<p>Jim Hurst, head of Winston’s intellectual property group, affirmed that Murray’s addition will have a big impact on the expansion of the IP practice of the firm. “As our IP practice expands, it will look for the kind of experience and know-how that Mike brings to the table. His abilities are a great fit for the practice and firm, and will allow us to expand our services in a strategic way around the globe.”</p>

<p>For more than twenty years, Dumezich has represented numerous individuals and companies, including international financial institutions and public accounting firms, in complex tax controversies before the Internal Revenue Service and various state taxing authorities. He will head Winston &amp; Strawn&#8217;s highly-regarded Federal Tax Controversy Practice.</p>
<p>Colton is also experienced in all aspects of tax controversy work, ranging from IRS examinations through administrative appeals and litigation.</p>
<p>Most recently, Dumezich has represented taxpayers in matters under IRS Examination or in IRS Appeals exceeding $4 billion in proposed adjustments or settlements.</p>
<p>Colton has extensive experience with all aspects of tax-advantaged transactions, discovery disputes, and privilege issues. He has helped garner favorable outcomes over the years for such important entities as United Parcel Service of America and Comcast Corporation.</p>

Joining the firm are corporate and M&amp;A attorney Jem Li, who will be managing partner of Winston &amp; Strawn’s Beijing office, and corporate associates Haihang (Helen) Zhang and Na (April) Wang.</p>
<p>Li has practiced at international law firms for more than a decade in New York as well as mainland China. Speaking native Chinese and fluent in English, Li&#8217;s experience includes complex cross-border commercial transactions, mergers and acquisitions, private equity investment, venture capital investment, and foreign direct investment in China. He has practiced in China since 2004.</p>
<p>&#8220;We&#8217;re delighted that Jem has joined our Beijing office because he gives additional quality and breadth,” said Thomas Fitzgerald, Winston &amp; Strawn’s managing partner. “China clearly plays an important role to our strategic vision of expanding the firm&#8217;s footprint in Asia and we are excited about the opportunity to provide even stronger service to our clients there.”</p>
<p>Li obtained his M.I.A. from Columbia University, and his J.D. from Pace University.</p>

James R. Thompson, Jr. will receive <em>The American Lawyer</em> magazine&#8217;s 2010 &#8220;Lifetime Achievement&#8221; award on October 27 during the legal publisher&#8217;s annual &#8220;A-List Awards&#8221; dinner in New York.</p>
<p>The annual award is reserved for lawyers who have demonstrated &#8220;exemplary public service and outstanding professional success&#8221; during their extended careers.</p>
<p>&#8220;We are so proud of Jim putting his civic duty at the core of his life&#8217;s work,&#8221; said Winston &amp; Strawn Chairman Dan K. Webb.</p>
<p>&#8220;Jim&#8217;s well-known example still inspires his colleagues,&#8221; agreed Thomas Fitzgerald, the firm&#8217;s Managing Partner. &#8220;We want to continue the legacy of his uncompromising ideals, in which the public welfare and clients always come first.&#8221;</p>
<p>Thompson, who has played an integral role in the firm&#8217;s global growth, served as Illinois&#8217;s governor for 14 years and longer than any other chief executive in the state&#8217;s history. Prior to this public leadership role, Thompson worked at the state prosecutor&#8217;s office in Cook County, Illinois, and the state attorney general&#8217;s office, where he argued more than 200 cases before the Illinois Supreme Court. He was appointed U.S. Attorney for the Northern District of Illinois in 1971, where he gained a national reputation for being tough on crime, while prosecuting several high profile public corruption cases against members of both parties.</p>
<p>First joining Winston &amp; Strawn as a partner in 1975, Thompson was prompted to run for high office a year later because he &#8220;saw it as an opportunity to turn the state around.&#8221; During most of Thompson&#8217;s record-breaking four terms, the traditionally-partisan Illinois enjoyed a rare period of cooperation between political parties, economic growth, and a balanced budget.</p>
<p>Thompson&#8217;s public service record continued unabated after leaving the Governor&#8217;s Mansion in 1991 and rejoining Winston. Most notably, he served as Chairman of the Bush Intelligence Oversight Board during the 1990&#8242;s and later, as a member of the president&#8217;s National Commission on Terrorist Attacks Upon the United States, which held hearings in the wake of the September 11, 2001 terrorist attacks and made recommendations to Congress and the President that are still being implemented.</p>
<p>Thompson served as Winston &amp; Strawn&#8217;s Chairman and CEO until 2006, when Webb ascended the firm&#8217;s top leadership post. Over the years, he has successfully managed to complete hundreds of cases and appeals in the state and federal courts. Thompson&#8217;s law practice continues to be extensive and focused on government relations, complex litigation, and corporate governance, as well as corporate investigations.</p>
<p>He is also Chairman of the Illinois Sports Facilities Authority and a member of the Illinois Supreme Court Historic Preservation Commission.</p>

Papez, will join <a href="http://www.winston.com/index.cfm?contentID=3">Winston &amp; Strawn </a>as a partner, the firm announced today.</p>
<p>Papez recently served as Deputy Assistant Attorney General in the U.S. Justice Department&#8217;s Office of Legal Counsel and as law clerk to U.S. Supreme Court Justice Clarence Thomas. She was also a former appellate and commercial litigation partner at Kirkland &amp; Ellis LLP, and is experienced in Executive Branch and private practice. Additionally, her perspective on the judiciary and top-level appellate work is rare.</p>
<p>As Deputy Assistant Attorney General from 2007 to 2009, Papez advised senior officials at the White House and Executive Branch agencies on a wide range of legislative, regulatory, and enforcement matters concerning financial regulation, national security, intellectual property, and other areas now governed by, among other things, the recently-amended False Claims Act (FCA), the Dodd-Frank Wall Street Financial Reform Act, the Patient Protection &amp; Affordable Care Act (PPACA or Health Reform Bill), and the Foreign Investment &amp; National Security Act (FINSA). She also testified and briefed members of Congress on matters concerning pharmaceutical and intellectual property regulation, government contracting, and whistleblower rights, and represented the United States in several federal appeals before working on a wide range of current legal issues and trends at the Supreme Court.</p>
<p>As a litigator at Kirkland from 2000 to 2007, Papez represented corporate clients in appellate, commercial, and regulatory matters involving federal and state constitutional questions, complex commercial and procedural issues, antitrust, securities, and bankruptcy-related disputes, corporate and consumer fraud, contract, and product claims, and trade and telecommunications regulation. Prior to entering private practice, Papez served as a research analyst in the National Security and International Affairs Division of the White House Office of Science and Technology Policy and as law clerk to the Honorable Danny J. Boggs on the U.S. Court of Appeals for the Sixth Circuit.</p>
<p>In today’s press release at PR Newswire, Thomas Frederick, chair of Winston&#8217;s Litigation Department, was quoted as saying: &#8220;Elizabeth brings a truly exceptional blend of experience and legal skills gained from her positions in both the public and private sectors.”</p>
<p>Papez earned her J.D. from Harvard Law School, where she was editor of the Harvard Law Review and articles and symposium editor of the Harvard Journal of Law &amp; Technology. She earned a B.S., summa cum laude, from Cornell University.</p>

James Levin and Warren Loui have joined <a href="http://www.winston.com/index.cfm?contentID=3">Winston &amp; Strawn LLP’s </a>Los Angeles office as partners.</p>
<p style="text-align: justify;">The move significantly expands its M&amp;A, securities, private equity, and finance capabilities on the West Coast. Levin joins from O&#8217;Melveny &amp; Myers LLP, where he was a partner in and former co-chair of the firm&#8217;s M&amp;A/Private Equity practices. Loui joins from Mayer Brown LLP, where he was a partner in its banking and finance department, and the Los Angeles Finance practice leader.</p>
<p style="text-align: justify;">The two men, who each have well established practices in Southern California, bring a rare combination of experience representing public and private companies in acquisitions and divestitures, securities offerings, and corporate finance transactions, including securitizations, structured and acquisition finance matters, and capital raises for emerging companies.</p>
<p style="text-align: justify;">Levin has represented numerous Fortune 500 companies as well as private companies in their acquisitions and business dispositions, and has advised many prominent investment banking firms.</p>
<p style="text-align: justify;">Loui&#8217;s representation of lenders and issuers includes acquisition financings of up to $3.7 billion, and structured financings and other securitizations in transactions valued up to $6 billion, including some of the first securitizations of non-performing loans and life settlements.</p>

Jacobs, a prominent litigator focusing on securities, accounting and auditing professional liability and ERISA litigation, has joined its litigation department in Chicago as a partner.</p>
<p>Jacobs, who joins Winston from Mayer Brown, brings more than 20 years of experience in a wide range of securities, accounting and auditing, ERISA, and other commercial disputes. Her experience includes the successful handling of complex individual, class, arbitration, and multidistrict actions at the trial and appellate level.</p>
<p>Formerly, Jacobs was an Assistant U.S. Attorney for the Northern District of Illinois&#8217; Criminal Division, where she prosecuted dozens of criminal matters, eventually concentrating on criminal financial institution fraud cases.</p>
<p>Jacobs co-tried the high profile Lexecon v. Milberg case. The case resulted in a $45 million jury verdict against the law firm in question and led to a $50 million settlement. She also co-tried and won, on behalf of a Big Four accounting firm, a massive federal securities fraud action brought in the Southern District of New York.</p>
<p>According to the release at Winston &amp; Strawn’s website, Thomas Frederick, chair of Winston&#8217;s Litigation Department was quoted as saying: &#8220;Caryn clearly brings enormous talent, energy, and experience to our litigation team. The depth of her experience in complex securities and corporate governance litigation will greatly increase the depth of our national litigation services and will undoubtedly be welcomed by our corporate clientele.&#8221;</p>

<p>McKool Smith, which is considered a premier trial law firm with more than 120 attorneys in six cities, helped clients secure four of the country’s Top 100 Verdicts in 2009, according to a recent report from The National Law Journal. No other firm won more than two, according to a firm press release.</p>
<p>“We take great pride in handling every case with the intention of winning and winning big,” said Mike McKool, co-founder of McKool Smith. “That mindset is one reason why we have won more of the country’s top verdicts than any other firm, and it’s the kind of thinking I know our clients want when they’re headed to court.”</p>
<p>McKool Smith’s successful verdicts cited by The National Law Journal include:</p>
<p>i4i v. Microsoft – McKool Smith won a $200 million patent infringement verdict for Toronto-based software maker i4i Inc. against software giant Microsoft. Principals Douglas Cawley, Gordon White, Jeff Carter, Kevin Burgess, Rosemary Snider, Jill Lynch and Randy Carter led the way for McKool.</p>
<p>Versata v. SAP AG – Led by firm principals Sam Baxter, Scott Cole, Steve Pollinger and Ted Stevenson, McKool Smith won a $138 million patent infringement verdict for software maker Versata Software Inc. against global software provider SAP AG.</p>
<p>City of San Antonio vs. Hotels.com, et al. – McKool Smith won a $20 million jury verdict for the city of San Antonio and more than 170 Texas cities in a class-action lawsuit over unpaid hotel occupancy taxes. Gary Gruciani, Tom Graves and Steve Wolens were at the helm for McKool.</p>
<p>OPTi Inc. v. Apple Inc. – Led by principals Carol Butner and Rosemary Snider and co-counsels Michael Brody and Taras Gracey, partners at <a href="http://www.winston.com">Winston &amp; Strawn</a>, the team won a $19 million patent infringement verdict on behalf of technology provider OPTi Inc. against Apple.</p>

To absorb decreasing revenues the firm trimmed its bonus pool and both associates and non-equity partners took <a href="http://www.jdjournal.com/2010/02/12/winston-strawn-keeps-salaries-frozen/">compensation hits</a> in 2009. The average compensation for non-equity partners at Winston &amp; Strawn declined by 14.5%. There was also a drop in non-equity partners from 210 to 197 last year. Overall headcount decreased by 3% to 843 lawyers.</p>

<p>The memo from Thomas P. Fitzgerald outlines an associate pay-scale beginning at the market rate of $160,000 for first-year associates. However, it also states associates salaries “will range up to the maximum base compensation levels set forth below.”</p>
<p>There is little detail given in the memo with regards as to how associates could reach the maximum, other than saying associates salaries “will be determined on a case-by-case basis based on seniority, performance and productivity factors and will be communicated separately to each associate.”</p>
<p>The increases will be retroactive to Feb. 1.</p>

Paul S. Pilecki and Michael A. Mancusi will be joining the firm’s Washington D.C. office from <a href="http://www.winston.com">Winston &amp; Strawn</a>.</p>
<p>Pilecki’s practice concentrates on representation of foreign and domestic banking organizations on regulatory and corporate matters. He also has experience helping bank organizations plan new activities and corporate structures for their U.S. activities, according to a firm press release.</p>
<p>Pilecki also serves as chair of the Executive Council of the Federal Bar Association’s Banking Committee.</p>
<p>Mancusi focuses his representation on foreign and domestic banking organizations in regulatory, compliance and enforcement matters. He also comes with experience representing clients in government and corporate internal investigations.</p>
<p>He currently serves as chair of the American Bar Association Banking Law Committee’s Enforcement, Director Liability, and Problems Banks Subcommittee.</p>

			<content:encoded><![CDATA[<p><a href="http://www.jdjournal.com/wp-content/uploads/2009/11/coins.jpg"><img class="alignright size-full wp-image-17997" title="coins" src="http://www.jdjournal.com/wp-content/uploads/2009/11/coins.jpg" alt="" width="100" height="75" /></a><a href="http://www.winston.com/">Winston &amp; Strawn</a> froze salaries last year and now it appears that the freeze is still on.  Associates received emails today regarding their compensation and across the board, they are still the same as they were two years ago.  Third year associates are still making $160k.</p>
<p>This might seem like a way to increase business at the firm &#8211; pay associates less so the firm can advertise lower rates for its clients, but that isn&#8217;t the case.  Hourly rates for the associates&#8217; time have gone up.</p>
<p>Meanwhile, fellow Chicago denizen <a href="http://www.sidley.com/default.aspx">Sidley Austin</a> has continued to pay its associates at 2008 levels as well, while they evaluate the market.  Is it any surprise that the National Law Journal says the <a href="http://www.law.com/jsp/law/careercenter/lawArticleCareerCenter.jsp?id=1202442994233&amp;Chicago_Market_for_Laterals_Picking_Up">market for Chicago laterals is picking up</a>?</p>

Lawrence A. Larose and Samuel S. Kohn join as partners in the firm’s restructuring and insolvency group while William J. Grant has joined as senior counsel in the mergers and acquisitions practice.</span></p>
<p><span>Larose, who will head the financial restructuring practice, focuses his practice on the restructuring of financially troubled entities.<span> </span>He was previously with Dewey &amp; LeBoeuf, where he led the corporate restructuring practice. Kohn practices in the area of business reorganizations, including complex Chapter 11 cases.<span> </span>He also joins the firm from Dewey &amp; LeBoeuf.</span></p>
<p><span>Grant represents corporate clients and investment banks in financings and acquisitions, particularly in the healthcare, technology and media industries. He was previously a partner at Willkie Farr &amp; Gallagher.</span></p>
<p><span>Winston &amp; Strawn’s New York office has grown to over 200 attorneys and further expansion is expected this year, the firm said in a press release. Winston &amp; Strawn has 14 offices in Asia, Europe and the United States.</span></p>

			<content:encoded><![CDATA[<p><a href="http://www.jdjournal.com/wp-content/uploads/2008/12/winston_160x120.jpg"><img class="alignright size-medium wp-image-1361" src="http://www.jdjournal.com/wp-content/uploads/2008/12/winston_160x120.jpg" alt="" width="160" height="120" /></a>Robert Pringle of <a href="http://www.winston.com">Winston &amp; Strawn&#8217;s </a>San Francisco office has been named the 2010 Antitrust Lawyer of the Year as selected by the California State Bar Antitrust &amp; Unfair Competition Section. The honor was announced Wednesday by Paul Griffin, a partner in the firm and member of the section&#8217;s executive committee.</p>
<p>Pringle, who is also a partner in the firm, will be honored at a gala dinner in October following the Golden State Institute, which is a series of antitrust and unfair competition seminars presented by the section.</p>
<p>The award has been offered each year since 1991 and, according to a press release, honors  &#8220;the most prominent, respected and successful attorneys in terms of impact on the profession, and one who exemplifies the highest standards of collegiality, professionalism and commitment to the practice.&#8221;</p>
<p>Griffin added: &#8220;&#8221;Bob is truly an outstanding antitrust attorney who has had an exceptional career.  He is very deserving of this honor, which, over the years, has become a &#8216;lifetime achievement&#8217; award and is described by some as the equivalent of being inducted into the California &#8216;Antitrust Hall of Fame.&#8221;</p>
<p>Gene Crew won the award in 2009.</p>
