Although ATL is refraining from comment out of respect for the judicial system, you can find a juicy analysis of the case and why its unlikely to survive a motion to dismiss here.

Here’s a quick rundown of the background of the case: In September of 2007 Donald Marvin Jones, a Florida law professor, was arrested for solicitation after allegedly offering an undercover officer twenty dollars for sex. ATL reported on the case with great glee, including a photo montage of Jones provided to them by a third party, a picture of Jones taken from the University of Miami website, and a copy of the police incident report. The case against Jones was later dismissed, and expunged from the record.

Now Jones is suing ATL. The complaint brings forth three claims: 1) false light; 2) invasion of privacy; 3) and copyright infringement.

George Borkowski, the ex-RIAA lawyer who helped torpedo the Napster and Grokster file-sharing services, is leaving a slimy trail to Venable LLP’s Los Angeles office, as co-chairman of the firm’s national intellectual property litigation group.

Borkowski, founder of the IP & technology practice at LA’s Mitchell Silberberg & Knupp, joins the Washington-based Venable as a partner.

Borkowski joined Mitchell Silberberg in 1988. He was acting director of litigation for the Recording Industry Association of America from 2000 to 2001, representing the record company plaintiffs in litigation against Napster and Grokster, both of which were found to be liable for some level of copyright infringement.

It’s been pointed out by many commentators that if the RIAA had made a deal with the file-sharing services, instead of essentially putting them out of business, the record industry would be making all the money that is instead going to Steve Jobs through iTunes. Good work, George!

He also has represented the Motion Picture Association of America, the Hollywood lobby and censorship board, and other entertainment firms in copyright infringement and piracy cases. He has represented record labels in copyright infringement, royalty and trademark disputes, and has handled patent, trade secrets and anti-piracy cases for videogame, software and semiconductor companies.

Venable LLP, formerly known as Venable, Baetjer & Howard LLP, was founded in Baltimore after the Civil War. Today the firm maintains six Northeastern offices and specializes in patent litigation, labor & employment law and white collar investigations. Venable employs nearly 600 attorneys.

Bad news for Coldplay, the super successful British rock group. The band was sued on Thursday for copyright infringement by famous rock guitarist Joe Satriani. In the complaint filed in Los Angeles federal court, Satriani claims that the Coldplay song “Viva la Vida” (the title track of the band’s fourth album) incorporates “substantial original portions” of his 2004 song entitled “If I Could Fly” from his album “Is There Love in Space?”

All four of the band’s members – singer Chris Martin (husband of Gwyneth Paltrow), bass player Guy Berryman, guitarist Johnny Buckland, and drummer Will Champion – received a writing credit on the song.

Satriani has requested a jury trial, damages and “any and all profits” attributable to the alleged copyright infringement.

“Viva la Vida” has been a huge hit for the Grammy-award winning band. On Wednesday night, the band was nominated for seven Grammy Awards, including a Song of the Year nomination for “Viva la Vida.”
