Apple Sues Samsung Over Its Android Technology for $2.525 Billion

In one of the largest patent laws of its kind, Apple Inc has sued Samsung for $2.525 billion over their alleged infringement of the iphone and ipad with Samsung’s Android technology smart phones. As Apple claims, Samsung owes “substantial monetary damages” for when they illegally “chose to compete by copying Apple.” Samsung claims that it in fact originated some of the technology in question, and has countersued Apple.

 

If Apple wins, not only will Samsung have to take its phones off the market until they can design them around the patent laws, but Android itself, which is used by many phone companies, will be stifled. Apple seeks to instate a permanent injunction to stop future violations.

 

Why $2.525 billion dollars? Samsung has overtaken Apple as the larger maker of Smartphones. Apple claims Samsung has cost apple $500 million, while making billions themselves.

The technology is question regards the look and feel of the iphone and ipad tablet computers, the “rubber banding” design for how images snap back into place after the user has scrolled with his finger, and how the iphone communicates with its operating system.

 

Not only does Apple have to make its case, but it has to convince a jury. The use of a jury in such a trial is rare and leads to unpredictable outcomes. The jury, after all, will be peopled by those ignorant of computer technology and the nuances of patent law. Apple and Samsung will not only have to make their cases, but make them in simple terms.

 

The judge presiding over the case, which takes place in San Jose, California, will be 43-year-old Lucy H. Koh, who not only has worked as a patent lawyer for nine years in a private practice, but has even worked on a patent case against Apple.

 

The outcome of the case is expected to affect how those markets grow in the future, and determine how technology patents — which have lately increased the overall number of patents and the amount of patent litigation significantly — will play out in the future.

 

Samsung will likely cite the product demands that make the Smartphones look alike. “It’s the microwave-oven argument,” said Mr. Carrier of Rutgers. “A microwave oven, like a Smartphone or a tablet computer, but its nature tends to have a certain form.” Resemblance “doesn’t always mean you’ve got patent infringement.”

 

Apple will be represented by Michael Jacobs of Morrison & Foerster; Samsung will be represented by Charles Verhoeven of Quinn Emanuel Urquhart Oliver & Hedges.

    Well if apple can sue over size and shape. Then Gene Rodenberry’s estate should sue apple. Not for money to shut their fat mouths up.

    Star trek actually visualized ipod touchs and ipdas 10-15 years before they made them. So Suin for a rounded corner or a slim style is ridiculous since they did not invent it.

    In fact allowing any company to copyright/patent/ or sure over something so stupid is ridiculous.

    Apple stocks are dropping for a reason. this suit will not help them.

    Samsung has a lot of its own designs and their phones are way more equipped than iPhone. Apple is just upset because people are able to purchase a product for a cheaper price on which contain more “creativity” than Apple. Why only due Samsung? Why not others? This is ignorant.

    Talk about biting the hand that feeds ya. Did you guys forget who manufacturers your touch screens. Samsung, what are you going to do now?. Manufacturer a non touch screen? Good luck selling that one APPLE. Plus no 4g devices that apple can tap into boy talk about taking 2 huge steps backwards. Not to mention every time apple launches a new product it looks exactly the same as the one before it. Sounds to me like there just pissed off because of the new dog on the block go Google!!!

    Looks like apple lost a lot more than just Steve; they lost class! I’ve only owned one apple product in my life ever since I bought a Samsung galaxy II skyrocket months ago I’ve been wanting to sell my Ipod 4 touch!!

    Apple is taking the IT industry backwards by suing companies for small things, just because they have falling share price. Although, Android has copied the ‘look’ that iOS originally had but its stupid to sue other companies over this small detail.

    Learn to use proper grammar, “apple is awsome fuck all people that rights bad about it your just pissed that apples better than samsung the phones are the phones of the future.” There are so many things wrong with that comment it’s insane. I own both Apple, and Samsung products. A Mac book and two Ipods from Apple, and my Samsung Galaxy S3. I love every single one. Samsung kicked Apples butt in the mobile phone fight, and Apple kicks butt in computers and everything else. So no need to go so polarized. They should just admit defeat and start working on IPhone 5s now so they can try and beat Samsung next time.

    Wow greed sure is a nasty taskmaster. Lets face it, Steve Jobs was an unpleasant man to deal with, and so is the company he has left behind. There is a place in the sun for all, but greed does not agree. So this is how adults play, I am sure that they never learned this growing up. Apple must learn that they are not the only ones making good phones, and that said that android phones are well received.

    competition is always present in the retail business. if apple cant deal with that, then they surely do suck as a company. no bias, but i love both companies, they make good products. i just hope they dont get too greedy enough. innovation is the greatest strategy here. samsung is very competitive , i must give credit to that. apple should do sumthing about it or else they would suffer a decreasing market share.
