California Supreme Court Grants Whistleblower Protection

The California Supreme Court granted whistle-blowers in state government protection on Thursday in a case where a low-level employee reported that her superior had violated a regulation she was supposed to enforce.

“The Legislature enacted the California Whistleblower Protection Act to protect the right of state employees ‘to report waste, fraud, abuse of authority, violation of law or threat to public health without fear of retribution,’ ” Justice Joyce L. Kennard wrote for a unanimous court.

“In adopting the act, the Legislature expressly found ‘that public servants best serve the citizenry when they can be candid and honest without reservation in conducting the people’s business.’”

    THE SUPREME COURT WAS HONEST AND EQUITIBLE AND BACKED TMY HONESTY AND INTEGRITY. THIS SENDS A MESSAGE TO CALIFORNIA STATE DEPARTMENTAL MANAGEMENT THAT ILLEGAL ACTS CANNOT BE COVERED UP BY THREATENING AND RETAIALATING AGAINST THEIR SUBORTINATES. FINALLY AFTER 7 YEARS…JUSTICE. THANK YOU SUPREME COURT JUSTICES FOR A UNANOMOUS DECISION.

    Carole, all this means is that you didn’t have to file a writ prior to filing your civil action. You still have to prove your case. And Erik’s right, why are you shouting?

    SHOUTING BECAUSE THE PRIOR APPELLATE COURT DECISION WOULD HAVE BARRED ANY FURTHER WHISTLEBLOWERE CLAIMS SINCE THE STATE PERSONNEL BOARD HAS NOT ISSUED POSITIVE FINDINGS IN A WHISTLE BLOWER COMPLAINT FOR YEARS. YOU REALLY NEED TO READ THE REVERSED APPELLATE PUBLISHED OPINION TO REALIZE THE SHOUTING, EXCITEMENT AND MAGNATUDE. THIS WAS NEVER ABOUT THE MONEY…BUT ABOUT VIOLENCE IN THE WORKPLACE FOR REPORTING FRADULENT ACTIVITY WITHIN STATE CIVIL SERVICE…..

    How does one go about reporting WASTE and ABUSE of AUTHORITY? I have some whistleblowing of my own to do, but am not sure which way to turn. Any assistance would be most appreciated. Thank you.

    Likewise, who can one turn to to uphold the law in Los Angeles superior court? The taking of illegal payments, by judges, given by the county, resulting in judgments for the county, in most cases heard by a judge. And the abduction and false imprisonment of Richard Fine, by judge Yaffe, and the LA sheriff, complete with false court filings, have been rejected for investigation, by the FBI, DOJ, the sheriff dept. itself, the governor, based on “not enough evidence to initiate an investigation”, after enough hard evidence had been given them for a solid conviction. When the enforcers of the law, won’t, where do you go?

    To any future lawyers, give it up. The “rule of law” is no longer valid in the US. The justice dept. is so blatantly corrupt that unless you work for the government, you’ll never win a case in a US court. Judges no longer follow the law they make up their own, and if they don’t like you you risk jail, seriously. Lawyers are afraid to take certain cases in LA because of the chance of disbarment, and jail. What kind of country do we have here? A terrorist regime.

    The ninth circuit just upheld judges hearing cases in which they’re named defendant, and dismissing them before a recusal petition could be filed. Upheld on… no grounds, just retribution.
